Yes. Whether you are a self-represented litigant or a legal professional, you can now initiate a case from your home or office. Here is the official process for filing a case online.
1. Create an Account
Before filing, you must have an active profile on the portal.
- Visit the official Judiciary e-Filing Portal or access it via your eCitizen account.
- Select “Sign Up” and choose your category: Individual (Self-Represented), Advocate, or Organization.
- Enter your National ID number, phone number, and a valid email address.
- Verify your account using the OTP code sent to your phone or email.
2. Prepare Your Documents
The system will only accept documents in PDF format. Ensure your paperwork is clear and legible.
- Scan your Plaint, Affidavits, and any Supporting Exhibits.
- Label each PDF clearly (e.g., “Main_Plaint_Jan2026.pdf”).
- Ensure the file size per document does not exceed the limit (usually 10MB).
3. Initiate a New Case
Once logged in, look for the dashboard menu.
- Click on “File New Case”.
- Select Court Station: Choose the specific court where you want to file (e.g., Milimani High Court, Mombasa Law Courts).
- Select Court Division: Choose the relevant division (e.g., Civil, Commercial, Family, or Small Claims).
- Enter Party Details: Fill in the names and contact information of the Plaintiff (you) and the Defendant.
4. Upload Documents and Assess Fees
This is where you officially submit your paperwork.
- Upload your PDFs to the corresponding slots provided.
- The system will automatically calculate the Court Fees based on the type of case and number of pages.
- Click “Request Assessment” to confirm the total amount due.
5. Pay Court Fees
You must pay the assessed fees before the court registry reviews your case.
- A Payment Registration Number (PRN) or Invoice will be generated.
- Payment Method: Use M-Pesa (Paybill 222222), Airtel Money, or Bank Transfer.
- Enter the PRN as the account number.
- Once paid, the system will instantly generate an electronic Receipt.
6. Case Approval and Numbering
After payment, your file moves to the Court Registry for verification.
- A registrar will review your documents for compliance.
- If correct, the system will assign a Case Number (e.g., HCCIV/E001/2026).
- You will receive an email and SMS notification once the case is officially “Filed.”
